Terms & Conditions

These Terms & Conditions ("Agreement") govern the use of web and document accessibility services provided by Web Audit Solutions LLC ("Company," "we," "us," or "our") through our website and associated services.

By accessing or using our services, you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you may not access or use our services.

 

1. Services

Our services encompass a range of solutions focused on web accessibility compliance. These include:

1.1a. Comprehensive website accessibility checks (desktop and mobile versions, automatic scan and manual audit);

1.1b. Document remediation services for various formats, including PDF, Word, Excel, and PowerPoint.

 

2. Scope

2.1. Guidelines and Laws. We adhere to recognized accessibility standards and guidelines, including but not limited to the Web Content Accessibility Guidelines (WCAG 2.0 & 2.1 & 2.2), Section 508, and EN 301-549, as well as relevant US and EU laws and regulations.

2.2. Remediation. We will provide solution for the remediation, such as the correct code snippets, without altering Client website's code directly.

2.3. Mobile Apps. Our services do not extend to iOS and Android mobile app accessibility audit and remediation.

 

3. Client Responsibilities

3.1. Cooperation. Clients are required to cooperate with us by providing necessary access to their websites (if the website blocks automatic tools) and documents for assessment and remediation purposes.

3.2. Accuracy and Legality. Client is responsible for ensuring the accuracy, legality, and content of all data provided. Client warrants having appropriate rights and permissions for data usage, ensuring it does not violate third-party rights, laws, or agreements.

3.3. No Sensitive Personal Information. Client agrees not to handle Sensitive Personal Information using our services. We are not HIPAA or PCI DSS compliant and hold no liability for such data.

3.4. Review and Action. Clients agree to review the analysis results and take necessary actions to improve accessibility. Our analysis and audit serve as a starting point, acknowledging that accessibility is an ongoing process with evolving standards.

 

4. Limitation of Liability

4.1. Warranty Disclaimer. Company’s services are designed to audit websites for WCAG accessibility and create a roadmap toward WCAG conformance. However, please note the following:
4.1a. Some of our services (such as the Express Audit) by their nature do not certify full compliance with the Americans with Disabilities Act of 1990, Section 508 of the Rehabilitation Act of 1973, or any other applicable law.
4.1b. All services are provided “as is.” Our Company and its suppliers make no other warranties, express or implied, including but not limited to warranties of non-infringement.
4.1c. Our liability does not extend to communication results or failures, delays, interruptions, or service problems beyond our reasonable control.
4.1d. Clients may have other statutory rights, but the duration of any required warranties is limited to the shortest period permitted by law.

4.2. Damages. Under no circumstances shall the Company be held liable for any special, incidental, indirect, or consequential damages of any kind (including, but not limited to, damages for loss of profits, loss of data or other information, business interruption, loss of privacy) arising out of or in connection with the use of our services.

4.3. Automatic Tools Limitations. While automatic tools identify accessibility issues, they have inherent limitations. Manual testing remains essential for comprehensive assessment.

 

5. Intellectual Property

5.1. Company ownership. All intellectual property rights in our services, including but not limited to code snippets, assessments, and reports, remain the property of the Company.
5.2. Client Use. Clients are granted a non-exclusive, non-transferable license to use any code snippets or remediated documents provided by us solely for their own website or document purposes.

 

6. Confidentiality and Protection

We will treat all client information and data as confidential and will not disclose it to third parties except as required by law.

 

7. Governing Law and Dispute Resolution

7.1. Jurisdiction. This Agreement shall be governed by the laws of the United States, without regard to its conflict of law provisions.

7.2. Informal Resolution. Any disputes shall first be attempted to be resolved informally by contacting the Company.

7.3. Arbitration. Any dispute arising out of or relating to this Agreement shall be resolved through binding arbitration in accordance with the rules of American Arbitration Association (AAA).

 

8. Miscellaneous

8.1. Modification. We reserve the right to modify this Agreement at any time. Any such modifications will be effective immediately upon posting on our website. If a revision is material, we will make reasonable efforts to provide at least 30 days notice prior to any new terms taking effect.
8.2. Severability. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
By using our services, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
